What is FSSAI?
Food Safety and Standards Authority of India (FSSAI) is an autonomous body established under the Ministry of Health & Family Welfare, Government of India. FSSAI is responsible for protecting and promoting public health through the regulation and supervision of food safety. A FSSAI registration certificate comes with a 14 digit License number to FBOs which is required to be printed on all the food products with FSSAI logo. The license can be applied for a minimum 1 year to maximum 5 years; it can again be renewed or re-applied for as per rules stated under Food Safety & Standards Act, 2006.
Who requires FSSAI Registration and Licensing?
Eligible food business operators like manufacturers, storage, transporters, retailers, marketers, distributors, and other business related to food need to take a license from the state authority. Even person intending to start cloud business for Swiggy or Zomato has to mandatorily obtain FSSAI Registration or FSSAI License online.
Shall I go for FSSAI Registration or FSSAI License?
In India allotting registration certificate or license to food, business is governed by the Food Safety and Standards Regulations 2011. The size and nature of your business defines whether you have to obtain an FSSAI registration or FSSAI License.
FSSAI registration is required for a category of food business which is called petty food business. Petty food business or petty food operator is defined as an FBO who is a manufacturer or sells any article of food himself as a petty retailer, hawker, itinerant vendor or temporary stallholder. Food Businesses having a turnover of less than 12 lacs are eligible to obtain FSSAI Basic Registration. FBOs in this category are required to obtain an FSSAI registration by submitting an application for registration in Form A. FSSAI registration certificate contains the registration number and a photo of the applicant. FBO has to display this certificate at the place of food business at all times while carrying on the food business.
Any person or company which cannot be categorized as a petty food business operator is required to obtain an FSSAI license for operating a food business in India. An applicant can apply for an FSSAI license which is of two types, State FSSAI License and Central FSSAI License. Based on the annual turnover and presence in one or more states, FBOs need to apply for State or Central License. Any large food business which is manufacturing, processing, transporting and importing food products require central FSSAI license while medium-sized food manufacturers, processor, and transporters need a State License. The fee and process of obtaining an FSSAI license is more complex than securing an FSSAI registration. FSSAI license application is made in Form B while for FSSAI Registration, the applicant is required to fill Form A.
State License or Central License?
FSSAI License is of two types:
Food Businesses having turnover above Rs. 12 lacs and up to Rs. 20 crores can opt for State License.
Those in the food business and has a turnover of Rs. 20 crores and above are required to obtain Central FSSAI License.
